Reasonable Suspicion FBI Mission Creeps


Wrong guy, wrong height – NINE inch difference…it’s just wrong. Mind you, I think drugs are stupid and even though the guy had drugs on him, this illustrious FBI Violent Crimes Task Force ‘dot squad’ was way wrong in this case. KSCO 20110902190.xml&docbase=CSLWAR3-2007-CURR&SizeDisp=7

“The officers stated that there was nothing suspicious about Johnson’s and Brown’s actions.

Second, the officers either lacked reliable information or chose to ignore the available information. … Yet officers ignored the differences in appearances, including the significant disparity in height.

We conclude that under the totality of the circumstances the task-force officers lacked reasonable suspicion as a matter of law. We reverse the Court of Appeals and the district court and vacate the sentences.”


I wonder if he will sue for malicious prosecution? I know I would.
