Reasonable Suspicion FBI Mission Creeps

STATE vs. JOHNSON

Wrong guy, wrong height – NINE inch difference…it’s just wrong. Mind you, I think drugs are stupid and even though the guy had drugs on him, this illustrious FBI Violent Crimes Task Force ‘dot squad’ was way wrong in this case.

“The officers stated that there was nothing suspicious about Johnson’s and Brown’s actions.

Second, the officers either lacked reliable information or chose to ignore the available information. … Yet officers ignored the differences in appearances, including the significant disparity in height.

We conclude that under the totality of the circumstances the task-force officers lacked reasonable suspicion as a matter of law. We reverse the Court of Appeals and the district court and vacate the sentences.”
